Mr. Frances Cheyne and his brother, William, were made burgesses of Aberdeen, 9 May 1582. Francis was listed 19th of 42 persons made burgesses as gentlemen, ex gratia. The listed were composed of the notables of the county and included the Earl of Huntly, George Meldrum of Fyvie, Gordon of Haddo, William Gordon, apparent of Gycht. Their entry reads "Ther names efter following maid burgesses as gentlemen nocht to be occupiaris nor handlersi w't merchandris...". Following the 42 was this "This four names that eftir followis maid fre the said day quha occupeis w't merchandrels ... Wm. Cheyn, broder to Frances Chen -- ex gratia". A footnote followed "The aucht day of May heirefter pntit. to my lord Huntly at the command of the provost and ballies tua gallowns of Vyne and twelf boistis confectiouns succur cost vj lib xiij s iiij d". Guildry Accounts.2,3

He was a witness to a charter of assignation, dated 1 December 1589, from Alexander, Earl of Sutherland to George, Earl of Huntly of certain lands in Aboyne. He was styled Mr. Francis Chene.4

Francis Cheyne of Cragye died in 1604.5

Robert Cheyne 1st of Vaila married Margaret Strang.2

From Fasti Ecclesiiae Scoticanae, under the Parish of Tingwall, Whiteness and Weisdale, is this listing: "1682 Robert Cheyne, mentioned as reader. Probably Robert Cheyne of Urie, ancestor of the Vaila family".3

Robert involved in a legal action outlined in Zetland Family Histories. "In the trial of Cultmalindie for oppression, one of the charges against Laurence Bruce was that, ‘By pronounciation of wrongus and false judgment and sentences against the King's Majesty's lieges of the said country, and causing his deputes thereafter to reduce and retreat the same as he did to Andrew Mowat, Mr Robert Cheyne and Andrew Hawick of Skatsta, and diverse others, and be the receiving fra the said Andrew Mowat, seven score of angel-nobles, and ane chene of gold worth xl angels, and fra Mr Robert Cheyne and Andrew Hawick, ane hundreth angels, and that by the way of brybrie for corrupting of justice’. On 29th July, 1586, he had precept of sasine in his favor granted by Robert, Earl of Orkney, on the narrative of a double poinding between him and Andrew Hawick of Scatsta. The said parties were ordained to appear at Scalloway bankis, on the 27th July, 1586, and there produce their titles to the lands of ‘Valley and Valey Guidis’, and the said Mr Robert having produced the grant made to him by the King's Majesty of Scotland of date the 18th day of October, 1580, and the said Andrew Hawick pretending nothing that might cut the said title, the Earl found Mr Robert entitled to possession of the said lands, and granted warrant for his infeftment. In 1596, he complained to the Privy Council that on I Ith April, 1596, when he came to St. Gregory's kirk in Northmaven, where he was accustomed to administer justice, and while there trying an action at the instance of a poor widow, Marion Johnnesdaughter against Andrew Hawick, he was attacked, and wounded by the said Andrew, Daniel his brother, John Strang, William Wilson, and others. His assailants having been summoned to appear, and not appearing, were denounced rebels".4

Robert Cheyne of Vaila was biographied in Zetland Family Histories. His entry reads "Robert Cheyne of Ury, brother of Francis Cheyne of Craigentarves, was Bailie of Tingwall in 1568, and Commissary of Zetland about 1590...He was seised in a last of land in Melby, on 10th August, 1590. He married Margaret Strang, and was father of: Thomas, his heir; Alexander; and, Harry, of Stapness".4

William Chein, (no other designation) was made a burgess of Aberdeen, 31 January 1584, ex gratia. (Guildry Accounts). That William was probably either (2253) or (2392).5

"In October (1600), with the permission of John Chene of Petfichie (2390), he (Patrick of Essilmont) sold to Henry, son of Alexander Annand of Auchterellon, the lands of Orchartoun occupied by William Chene. [Reg. Mag. Sig.]". That William was probably (2253), who was the uncle of Patrick of Essilmont (2267); Henry Annand was Patrick's nephew.

There was a sasine dated 8 December 1600, that involved Patrick Cheyne of Essilmont, John Cheyne of Petfichie and William Cheyne in Orchartson. That sasine probably was a result of the above.6,7

There were two sasines dated 1 March 1603 that involved William Cheyne 'in Esslemont' (2253). One named him only and the other included Alexander (2148), his son, and an Isobel Cheyne (2147), spouse of John Bruce in Esslemont. Isobel will later be identified as William's daughter.8

There was a sasine dated 29 July 1603 that included William Cheyne 'in Esslemont' (2253) and his son, Alexander (2148). Alexander was listed as Commissary General of Aberdeen and was married to Margaret Arbuthnot (13919).9

There were three sasines in Banffshire all dated 20 February 1604 that included Alexander (2148), in Aberdeen. They were folios 100, 103 and 104. The first and third also mentioned James Cheyne of Straloch (2198) and William Cheyne (his father, (2253)), in Mains of Essilmount. The second mentioned James of Straloch (2198). Also of note, the second and third referred to him as 'in Aberdeen, formerly in Auchry'.10

There were two sasines dated 18 June 1604 that included William Cheyne 'in Esslemont' (2253). These two are quite important, in that they state that Alexander Cheyne (2148), Commissary General of Aberdeen was his son and they state that William Cheyne 'in Essilmont' was formerly the William Cheyne 'in Orchartoun'. One named William's wife as Violet Reith, although we do not know if she was the mother of his children. The other confirmed Alexander's marriage to Margaret Arbuthnot.11

William Cheyne in Essilmont (2253), his son, Alexander Cheyne in Bathelnie (2148), and granddaughter, Margaret Cheyne (2149), were mentioned as involved in an action in Littlejohn, Records of the Sheriff Court of Aberdeenshire. The entry for the said action reads as follows: "1606, March 13. Service--Tutory. Margaret Cheyne, lawful daughter of Alexr. Cheyne in Bathelnie. William Cheyne in Essilmont, her paternal grandfather, appointed Tutor."12

William Cheyne (2253) in Essilmont, Alexr. Cheyne (13924) in Cauldwellis and Alexander Annand of Auchterellon (2276) were mentioned in Mair, Records of Ellon. The said entry, from the Kirk Session register, had to do with the election of Elders. The several baronies each had specific elders elected. In the baronies of Auchterellon, Waterton and Carmuk, the laird was one of the elders. Not so for Essilmont and Arnage. The Cheyne lairds were still Catholic. The said entry reads as follows: "1606 3rd Aug. A fresh election of Elders, for the release of those who have continued two years by gone. The elders to meet every second Wednesday, 'for doing of ye turnes of ye kirk.' For Auchterellon Barony. The Laird... Essilmont. Jhone Gordoun in Chapeltoun; Wm. Cheyne in Essilmont, and Jhone Legertwood in Crostein... Arnage. Alexr. Cheyne in Cauldwellis and John Stevinsoun at ye myll...".13

There was a sasine dated 1 July 1607 that included William Cheyne 'in Esslemont' (2253); his wife, Violet Reith and children, Alexander (2148), Isobel (2147) and Marjorie (2587); and Alexander's widow, Margaret Arbuthnot. Alexander was listed as 'in Haltoun of Bathelvis'. This probably had to do with the disposition of Alexander's property.14

There was a sasine dated 2 July 1607 that included William Cheyne 'in Esslemont' (2253) and his two daughters, Isobel (2147) and Marjorie (2587). Isobel was again referred to as spouse of John Bruce in Esslemont. Marjorie was the relict of William King in Newseat of Drumbreck. This sasine probably had to do with the disposition of William King's property.15

Ronald Cheyne (2159); his son, George Cheyne (2160); and, William Cheyne (2253) in Essilmont were mentioned in an action in Littlejohn, Records of the Sheriff Court of Aberdeenshire/. The entry for the said action reads as follows: "May 17 (1608). Cautionary Obligation. Wm. Cheyne in Essilmont in favor of John Chalmer of Balbithan. Wm. Cheyne bound himself as cautioner for Ronald and George Cheyne, for fulfilment of their obligations contained in the Act of Court of date 30 April."16

There was a sasine dated 10 December 1608 and another dated 18 December 1608 that included William Cheyne 'in Esslemont' (2253) and Walter Cheyne of Arnage (2391). In the first Walter's wife, Marjorie Cheyne (2199) was included; in the second William's wife, Violet Reith was included. Walter Cheyne of Arnage was, at this time, selling off most of the estate and William may have again found himself with his home sold by others.17

      John Cheyne educated at Marischal College, 1634-38, was taken prisoner with four other ministers who were opponents of the Covenant, June 1640. James Marquess of Montrose, stayed in his house, 12th March 1645.1,2

John was one of two ministers summoned to appear before the Commission in Edinburgh. The entry in Register of Commission of General Assembly reads "The Commission of the Assemblie continues the sumonds against Mr. James Hervie, minister at New Machar, and Mr. John Cheyn, minister at Kintour, wntill the ii day of November nixt, and ordaines them to be cited to that day, with certificatione, if they compeir not, ther absence will beholden for contempt, and lykwayes ordaines witnesses to be cited that same day".

He appears at the Commission, meeting in Aberdeen on the 13th of May 1647, only to have his hearing postponed until the next day. On the 14th, again from Register of Commission of General Assembly "This day Mr. Johne Cheyne personally present being heard, and some witnesses examined in his processe, the matter is continued untill Monday next".

Aberdeen, 18 May 1647, Register of Commission of General Assembly reports "The Commission of the Generall Assembly having this day heard from Mr. John Cheyne, minister at Kintore, and having also considered the deposition of diverse witnesses, find, by his own confession and the testimony of witnesses, that the said Mr. Johne did entertain diverse tymes James Grahame (Marquis of Montrose), and George Gordon, sometyme Marques of Huntlie, these excommunicat rebells, that he said grace to their meatt, and so joyned in acts of worship with them, that he never left his house when the rebells wer in these parts, which bewrayes his correspondence with them; Wnderstanding also his intemperancie, do therfor judge that he deserves the censure of deposition; And therfor did depose the said Mr. Johne Cheyne from the function of the ministrie and all exercise therof, declares the kirk of Kintore to be now vaiking, and appoints Mr. William Douglas, Professor of Divinitie in Aberden, to intimat this sentence upon Sabboth come fyfteen days in te kirk of Kintore according to the accustomed order".3

John Cheyne, Minister of Kintore (2264) and his son Robert (2215) were mentioned in Tayler, The Valuation of the County of Aberdeen for the Year 1667. The entry reads as follows: "Mr. John Cheyne, Minister of Kintore. An ardent Royalist, who was taken prisoner in 1640 and afterwards lodged Montrose in his house, 12th March, 1645. His son, Robert, married, 1654, Isobel Johnstone, daughter of Thomas Johnstone of Craig, Sheriff Depute of the Shire".4

In 1617, John Chene of Petfichie (2390) and Thomas Cheyne 2nd of Raniestoun were called in a case as one of the next of kin to Christian (2265), daughter of Francis Chene of Cragye.3

There was a sasine in Aberdeenshire dated 24 June 1622 that included Christina Cheyne (13957). She was the daughter of Francis Cheyne of Cragytarves and the wife of George Forbes of Bonaketill (?Bonnykelly). No other Cheynes were included.2

In 1594, Patrick Chene of Essilmont (2267) sold to a servitor, Robert Chene (4117), the mill lands of Mikle Auchry. [N.B.] The parentage of this Robert Cheyne is unknown.2

Patrick Cheyne 9th of Essilmont married Magdalen Fraser.3

On 25th June 1600 John Cheyne of Fortrie purchased the lands and barony of Esslemont, etc., from Patrick Cheyne. (Antiq., IV., p. 674.)4

"In October (1600), with the permission of John Chene of Petfichie (2390), he (Patrick of Essilmont) sold to Henry, son of Alexander Annand of Auchterellon, the lands of Orchartoun occupied by William Chene. [Reg. Mag. Sig.]". That William was probably (2253), who was the uncle of Patrick of Essilmont (2267); Henry Annand was Patrick's nephew.

There was a sasine dated 8 December 1600, that involved Patrick Cheyne of Essilmont, John Cheyne of Petfichie and William Cheyne in Orchartson. That sasine probably was a result of the above.5,6

James Cheyne (2162) in Pitsligo and James Chene in Petillie (4121) were in 1606 bound over not to commuicate with Patrck Cheyne of Essilmont (2267). [Ed. note] The parentage of both of the James' is not known.7

Patrick Cheyne 9th of Essilmont died before 28 November 1608.8,9

A William Chene (4122), indweller in the parish of 'Drumblait' was called before the Kirk Session of Ellon Parish and accused of slandering Magdalen Fraser, widow of Patrick Chene of Essilmont (2267). [Ed. note] The parentage of William Cheyne is not known.10

James Chene married Katherine Rutherford.2

James Cheyne of Pennand and Katherine Rutherford were divorced.. They were mentioned in the biography of Alexander Rutherford of Rubislaw, Provost of Aberdeen. Alexander was her brother. The entry reads in part "... Katherine (Rutherford), who was married to James Cheyne, of Pennand, from whom she was divorced about the end of 1598. The cause of the divorce is not stated, but the Provost was a party to a deed of arrangement executed prior to the divorcement regarding the destination of the moneys secured under the marriage contract".3

James Chene married Elspet Gordon, 1600. James Chene of Pennen (2268), Elspet Gordon (2336) and another James Chene (4123) were mentioned in, A. Y. Cheyne, The Cheyne Family in Scotland. The said entry reads as follows: "James Chene...in 1600 married as his second wife, Elspeth, daughter of William Gordon of Gight, a certain James Chene being charged by the Ellon presbytery in February of that year with having performed the ceremony, 'he having no function in the ministrie'".4

James Chene of Pennen (2268), William Chene of Orchartoun (2025) and his son Alexander (2027) were mentioned in, A. Y. Cheyne, The Cheyne Family in Scotland. The said entry reads as follows: "In 1601 James was still an outlaw and there was a suspension of letters charging a number of inhabitants of Aberdeen not to intercommune with certain persons at the horn, amongst whom were James Chene of Pennen and Alexander, son of William Chene of Orchartoun. This Alexander Chene, a kinsman of James was his constant abettor in crime and companion in disgrace". Among the inhabitants charged were John Cheyne of Petfichie (2390) and Patrick Cheyne of Ferriehill (2388). Though mentioned as a kinsman, the exact relationship is yet to be determined.5

James Cheyne of Pennan (2268) was made Tutor of Essilmont, 28 November 1608. His brother, Patrick, 9th of Essilmont, had died and Patrick, 10th of Essilmont (2303) was still a minor. The entry in Littlejohn, Records of the Sheriff Court of Aberdeenshire reads as follows:"28 Novr. (1608). Service--Tutory. Patrick Cheyne, eldest son of Patrick Cheyne of Essilmont. James Cheyne of Pennan, brother of the deceased, chosen as Tutor".6,7

John Cheyne of Petfichie (2390), Thomas Cheyne of Ranietoun (2432) and James Cheyne of Pennan (2268), were mentioned in an action in Littlejohn, Records of the Sheriff Court of Aberdeenshire. The entry reads in part as follows: "March 6 (1611). Curatory. Wm. Turing of Foweraine. The next of kin called were ... Mr. John Cheyne of Petfichie, Thomas Cheyne of Ranietoune ... James Cheyne of Pennan. The minor chose several of the other names".8

James Cheyne of Pennan (2268) was mentioned in an action in Littlejohn, Records of the Sheriff Court of Aberdeenshire. The entry for the said action reads as follows: "Novr. 13 (1611). Loosing of Arrestments. Thomas Sym in Maynes of Esslemonth v. Thomas Catto in Bourhills of Esslemonth. Cautioner James Cheyne of Pennan."9

Patrick, 10th of Essilmont, left no issue and was probably deceased before 1631, in which year his uncle, James Chene of Pennan, succeeded to the title "of Essilmont".4

There were several sasines in Aberdeenshire dated 24 May 1603, 21 May 1608, 3 June 1603, 24 December 1618, 22 January 1623 and 1 August 1634 that included Margaret Cheyne (2271), spouse of Alexander Annand of Auchterellon.3

Margaret Cheyne (2271) was mentioned in an action in Littlejohn, Records of the Sheriff Court of Aberdeenshire/. The entry for the said action reads as follows: "May 18 (1608). Judicial Ratification. Margaret Cheyne, wife of Alexr. Annand of Auchterellon. This was the ratification of a wadset of the lands of Cuikstoun, In Ellon, for 400 merks, to Archibald Beanis for himself and Cristiane Annand, his wife in conjunct fee, &c."4

Margaret Cheyne (2271) and her husband, Alexander Annand of Ochtirellon (2276) were mentioned in Mair, Records of Ellon. The said entry reads as follows: "A memorial of the Annands in Ellon Churchyard on part of the old church wall, bears at the top the date of 1326. It is not supposed, however, that the family had settled in Ellon at so early a date. Their arms are in the centre and on the left hand side it is told that Alexander Annand Baron of Ochterellon died, 9th July 1601, and his wife, Margaret Fraser, daughter of Philorth, in Augt... On the right side '(in Latin)' 'Here lies Alexander Annand of Ochtirellon, son of the said Alexander, who died ... and his wife, Margaret Cheyne, daughter of Essilmont, who died ...'. The dates of the latter have never been filled, as they had been intended by the latter Alexander, who must have erected the memorial; and the reason most probably is that he and his family had departed from Auchterellon and the parish, before his death. At least the family of Udny is in Auchterellon by 1626". The aforementioned wall was part of the old church and is now preserved in the grounds of the new parish church of Ellon. Alexander Annand of Auchterellon was made a bailie of the Barony of Urie, 25 August 1624. The entry in The Barony Court of Urie. reads "The said day Alexander Annand, elder of Ochterallane, was constitut, creat, and ordeanit bailzie of the barrouny of Wry, who gie his ayth de fidelj administratione ay and quhill he be dischargit". A footnote followed "Alexander Annand succeeded his father in the lands of Auchterellon, in Aberdeenshire, in July 1601. He married Margaret, daughter of Cheyne of Esslemont (Pratt's Buchan, p. 264). Annand evidently resided in Wrie at this period, as he is subsequently designed 'Alexander Annand, Elder, in Finlawstoun', see p. 59, infra".7

The said entry, from the Kirk Session register, had to do with the election of Elders. The several baronies each had specific elders elected. In the baronies of Auchterellon, Waterton and Carmuk, the laird was one of the elders. Not so for Essilmont and Arnage. The Cheyne lairds were still Catholic. The elders to meet every second Wednesday, 'for doing of ye turnes of ye kirk.' For Auchterellon Barony. The Laird... Essilmont. Jhone Gordoun in Chapeltoun; Wm. Cheyne in Essilmont, and Jhone Legertwood in Crostein... Arnage. Alexr. Cheyne in Cauldwellis and John Stevinsoun at ye myll...".3

Margaret Cheyne (2271) and her husband, Alexander Annand of Ochtirellon (2276) were mentioned in Mair, Records of Ellon. The said entry reads as follows: "A memorial of the Annands in Ellon Churchyard on part of the old church wall, bears at the top the date of 1326. It is not supposed, however, that the family had settled in Ellon at so early a date. Their arms are in the centre and on the left hand side it is told that Alexander Annand Baron of Ochterellon died, 9th July 1601, and his wife, Margaret Fraser, daughter of Philorth, in Augt... On the right side '(in Latin)' 'Here lies Alexander Annand of Ochtirellon, son of the said Alexander, who died ... and his wife, Margaret Cheyne, daughter of Essilmont, who died ...'. The dates of the latter have never been filled, as they had been intended by the latter Alexander, who must have erected the memorial; and the reason most probably is that he and his family had departed from Auchterellon and the parish, before his death. At least the family of Udny is in Auchterellon by 1626". The aforementioned wall was part of the old church and is now preserved in the grounds of the new parish church of Ellon. Images of the preserved wall are attached.4,5

Alexander Annand of Auchterellon was made a bailie of the Barony of Urie, 25 August 1624. The entry in The Barony Court of Urie. reads "The said day Alexander Annand, elder of Ochterallane, was constitut, creat, and ordeanit bailzie of the barrouny of Wry, who gie his ayth de fidelj administratione ay and quhill he be dischargit". A footnote followed "Alexander Annand succeeded his father in the lands of Auchterellon, in Aberdeenshire, in July 1601. He married Margaret, daughter of Cheyne of Esslemont (Pratt's Buchan, p. 264). Annand evidently resided in Wrie at this period, as he is subsequently designed 'Alexander Annand, Elder, in Finlawstoun', see p. 59, infra".6
